When you use any of our services you must agree to the following terms and conditions.
General
- MiniMoo Creative reserves the right to refuse service and/or access to its website and server to anyone.
- MiniMoo Creative reserves the right to cease any web design or eCommerce work when MiniMoo Creative finds out (at its absolute discretion), after work has commenced, that the website is going to be used to sell illegal products (by Australian law) or display and/or provide links to illegal content such as, but not limited to, child pornography, pirated software and hacking/password cracking information.
- All quotes and invoices will be sent to customers via email. NO paper quote and invoice will be sent via post.
Cancellations & Refunds
- A quote is valid for 14 days and a 50% deposit is required before any works begin.
- MiniMoo Creative reserves the right to adjust the price as necessary if the 50% deposit is not received within 14 days after the quote date.
- All deposits and fees paid are non-refundable after the design brief is returned to MiniMoo Creative or after 14 days has elapsed since the date of deposit paid. Refunds will be less a $75 admin fee.
- Once the design work has been signed off prior to the website build all fees are payable in due course, no cancellations will be accepted and all services ordered must be paid for in full.
- The usability, functionality and/or limitations of both the website and eCommerce content management systems is no reason for not paying the balance of your website as you can get a 15-days FREE trial before purchase.
- If a customer contravenes the MiniMoo Creative terms and conditions, MiniMoo Creative reserves the right to terminate the service immediately and cease all works with no refund.
Website/eCommerce Design & Support
- All website and eCommerce design concepts are based on the design brief submitted and will be uploaded on MiniMoo Creative server in a password protected folder accessible only to customer. They are available to send by email if requested. No design concepts will be printed and sent by mail.
- All websites will be delivered with blank pages and/or a blank database unless there is prior written agreement that states otherwise or the plan purchased includes image upload. The customer is responsible for inserting copy, products and/or images etc.
- After the completion of the project, customer will be given all access to the website, ftp and database and is free to modify and move it to another hosting company in the future.
- If a logo design work has been purchased, this will need to be signed off before the website design is commenced.
- Support, FAQs and manuals for eCommerce projects are provided by BigCommerce and are available free of charge online to assist customers updating their websites.
- Support for website projects is provided by MiniMoo Creative and is available free of charge for 6 months after the completion of the project. All support inquiry is to be sent by email. MiniMoo Creative will call the customer when it is deemed necessary.
- FAQs and manuals for website projects are provided by WordPress and are available free of charge online to assist customers updating their websites.
- All MiniMoo Creative website and eCommerce are self managed and MiniMoo Creative is not responsible for any copy, editing or updating of the customer’s website. After the completion of the project, MiniMoo Creative is under no obligation to do any work on customer’s website unless contracted to do so.
- On all customer websites there is an authorship link on the footer that links to the MiniMoo Creative website. This footer link cannot be removed.
Disclaimer
- MiniMoo Creative and its employees shall not be liable, under any circumstances or legal theories whatsoever, for any loss of business, profits or goodwill, loss of use or data, interruption of business, or for any indirect, special, incidental or consequential damages of any character, even if MiniMoo Creative is aware of the risk of such damages, that result in any way from the Customer’s use or inability to use the online services or the software, or that result from errors, defects, omissions, delays in operation or transmission, or any other failure of performance of the website, servers or the software.
- Due to the fast changing nature of the Internet, the use of any information obtained by way of MiniMoo Creative is at the Customer’s own risk, and MiniMoo Creative denies any responsibility for the accuracy or quality of information obtained through its services.
Hardware, Equipment & Software
- The Customer agrees that he or she has the necessary knowledge to maintain the website and it is not the responsibility of MiniMoo Creative to provide this knowledge or customer support outside of the provided plan support.
- The Customer is responsible for and must provide all internet connection, computer, hardware and software equipment to access his or her website. MiniMoo Creative makes no warranties that the Customer’s equipment will be compatible with the our service.
Limited Liability
- The Customer expressly agrees that use of websites and services provided by MiniMoo Creative is at the Customer’s sole risk. Neither MiniMoo Creative, nor its employees and third party information and service providers warrant that the MiniMoo Creative service will not be interrupted or error free.
- Under no circumstances, including negligence, shall MiniMoo Creative, its employees and third party information and service providers will be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or inability to use the website services.
